A divorce is the legal process of ending a marriage. Lawyers and Judges in Ontario are required to ask each spouse if there is any chance of reconciliation and, if both want to do so, to refer the couple to Marriage Counselling.

If you wish to remarry following a divorce, you will need a certificate of divorce before you can obtain another marriage licence.

There is only one ground for divorce: marriage breakdown, which can be proven in one of three ways:

  • one year of living ‘separate and apart’
  • adultery
  • physical and mental cruelty

While you can start your divorce proceedings at any time after your separation, your divorce will not become final until you and your spouse have been separated for one year.

It is important to note that a Judge can refuse to grant a divorce if he or she is not satisfied that the appropriate amount of child support is being paid for the children.

Common Law relationships

When two people in a relationship have cohabited as spouses but are not formally married to one another, they also have certain rights upon separation. In Ontario, you must live together continuously for 3 years or have a child together and have maintained a relationship of some permanence in order to be considered common law spouses and eligible for spousal support.
